1. What these terms cover
These Terms of Use govern your use of the Proga website and any information you provide through our intake forms to request a Proga evaluation (the "Evaluation"). By submitting the form and checking the agreement box, you accept these terms on behalf of yourself and the company you represent.
2. The information you provide
To build your Evaluation, we collect the details you enter — such as your name, company, work email, company website, competitors, and any friction or goals you describe — along with any files or links you choose to share, and publicly available information about your company (see Section 6). We refer to all of this as your "Confidential Information," and we treat it as confidential regardless of whether it is marked as such.
3. How we use your information
We use your Confidential Information solely for the purpose of producing and improving your Evaluation and related analysis. We protect it with at least reasonable care, limit access to the people and advisors who need it to do this work and who are bound by confidentiality obligations, and do not disclose it to any third party without your prior consent. We do not use your Confidential Information for advertising, and we do not sell or rent it.
4. AI processing — and why we never train public models on your data
We may use private, business-tier artificial intelligence services (such as Anthropic's Claude on a paid Team or Enterprise plan) to analyze your Confidential Information, solely for the purpose above. Any such service is configured so that your information is not used to train public models and is subject to confidentiality terms substantially consistent with these Terms. We do not upload your Confidential Information to free or consumer-grade AI tools.
5. Storage and security
Your inputs are stored in Proga's own AWS account — not in a consumer app — and kept separate from other companies' working files. Everything you submit travels over an encrypted connection and is encrypted at rest, with prior versions retained so that deleted or overwritten items can be recovered. 6. Public information and the resolver
To save you time, we may review publicly available information about your company — for example your website, public reviews, and competitors — to pre-fill parts of your profile. Any LinkedIn URL you provide is used only to confirm your identity, company, and role; we do not crawl or scrape LinkedIn. You will always have the chance to review and correct auto-filled details before anything is run.
7. Ownership
Your Confidential Information remains yours. The deliverables we produce specifically for you may be used by your company for its internal business purposes. Proga's methodology — including its frameworks, questionnaires, prompts, scoring models, and software — remains Proga's sole property. We may use de-identified learnings to improve that methodology, provided they contain none of your Confidential Information.
8. Retention and deletion
You may ask us to return or delete your Confidential Information at any time by emailing us, and we will promptly do so; routine backup copies remain subject to these Terms until they age out. If required by law or valid legal process to disclose your information, we will, to the extent legally permitted, give you prompt notice and disclose only what is required.
9. Billing, plans, and cancellation
Paid engagements begin with a one-time setup fee of $500, which covers your initial customer-journey report and asset library and is charged when you check out. Ongoing access is a $100 per month subscription; the first monthly charge begins in your second month (roughly 30 days after checkout), and recurs monthly thereafter.
The monthly subscription carries a three-month minimum commitment. You may cancel at any time through the customer billing portal; cancellation takes effect at the end of your current billing period, and you remain responsible for the monthly fee through the end of the three-month minimum. Fees already paid are non-refundable except where required by law. Prices are in U.S. dollars and exclusive of any applicable taxes.
Payments, receipts, and payment-method changes are handled securely by our payment processor, Stripe; Proga does not store your full card details. If a payment fails, we may suspend access to the portal until the balance is resolved. We will give you reasonable notice before any change to these prices.
10. Private beta; no warranty
Proga is currently in private beta. The site, the Evaluation, and any output are provided "as is," without warranty of any kind, and do not create any obligation for either side to enter into a further business relationship.
11. Governing law and contact
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Questions, or a request to return or delete your data? Email jeremy@proga.ai.
